This is contingent upon your agreement, without any restrictions, to the Terms of Services (ToS) as detailed herein.

We currently offer two services:

  • Data Action Mentor Subscription: A mentorship program designed for data professionals to engage with expert professionals in Data, Analytics, and AI for mentorship and advice.
  • Data Action Mentor Masterclass: A new service providing structured educational content for data professionals.

2. Terms of Use

To access our services, registration on our website is necessary, though browsing is open to all users.

While we require accurate information from any and all third parties that collaborate with us or use our services, we do not endorse any of our members, users, mentees, mentors, or clients. Any information or advice exchanged between users on our platform, is out of our control, and we are not involved in any agreements parties enter into.

Any information perceived from our website or services comes “AS IS”. It is important to understand that reliance on any such information is at your own risk, and we are not liable for any resulting or related loss or damage.

Users are prohibited from transmitting harmful software, such as viruses or malware, through or to our website. You agree not to copy, reproduce, duplicate, sell, resell, or exploit any portion of our services, or access to our services, without our written permission. Our services should not be used for illegal purposes or in violation of any local, national, or international laws.

Whilst we have no control over users engagement conduct from both mentors and mentees, we would like to encourage to follow professional and ethical norms during engagement, and respect confidentiality related to information you have come to learn is confidential, or of confidential nature.

When contributing comments on our website or our community platform, you agree to ensure that they do not infringe upon any third-party rights, including copyright, trademark, privacy, or other proprietary rights. Your comments should be free from unlawful, offensive, or inappropriate content. You must not misrepresent the source of your comments, and you bear full responsibility for their accuracy. We do not accept any liability for comments posted by you or any third party.

7. Pricing, Payments and Fees

Unless stated otherwise, all fees and payments are quoted in U.S. Dollars. The User is responsible for paying all fees, payments and applicable taxes associated with our Website and Services.

Sebastian Hewing Consulting LLC may save User’s credit or debit card information, unless the User notifies Sebastian Hewing Consulting LLC otherwise through an email to [email protected]

By accepting this Agreement, the User is confirming that it is legally entitled to use the means of payment tendered and, in the case of card payments, that the User is either the cardholder or have the cardholder's express permission to utilize the card to effect payment. Sebastian Hewing Consulting LLC may refuse to process a transaction for any reason or refuse Service to anyone at any time at Sebastian Hewing Consulting LLC's sole discretion. Sebastian Hewing Consulting LLC will not be liable to any User or any third party by reason of refusing or suspending any transaction after processing has begun.

Data Action Mentor Subscription

The Data Action Mentor Subscription operates on a subscription model, providing an array of added-value services to its members. These include access to mentorship that is offered by mentors on a pro-bono basis, use of the help request feature, participation in expert session events, and entry into a private Slack community.

Each subscription is intended for individual use and is not to be shared with others unless subscribed to the Team Plan. Sharing our services with non-registered individuals will lead to a suspension of services.

8. Data Action Mentor Subscription Renewal Terms

Your subscription with us will automatically renew unless you cancel it at least 24 hours before your current subscription period ends.

We will process the charge for the renewal of your account within the 24-hour period leading up to the end of your current subscription period. The cost for automatic renewals will be the same as the original subscription price you paid, barring any one-time promotional offers.

You have the option to cancel your subscription either through the customer portal link of our third-party payment provider, which was provided to you at the time of your subscription, or by sending an email to [email protected].

9. Refund Policy

Data Action Mentor Subscription

Refunds are available within 30 days of initiating your membership with us, provided that no help request has been booked in the system during this period.

The option for a refund is void if a help request has been posted in the community and received replies.

To request a refund, please contact us via email at [email protected].

No refunds shall be made if these terms have been breached, or if the service has been discontinued permanently, or temporarily for maintenance or modification.

Data Action Mentor Masterclass

If you are not completely satisfied with your purchase, you may request a refund within fourteen (14) days of the purchase date.

Partial payments are being offered to guarantee the user's participation in a masterclass. These partial payments are refundable within seven (7) days after the announcement of the Masterclass launch date.

10. Termination Conditions

The termination of these Terms of Service (ToS) occur when you have cancelled your subscription and after your account has been deactivated.

Additionally, we retain the authority to modify or update these ToS. We may also terminate the provision of our services without prior notice if we believe there has been a breach of any provision in the ToS. In the event of such termination, any outstanding payments owed by you must be settled in full.

11. Data Action Mentor Subscription Membership Attendance Policy

We reserve the right to revoke membership in cases of attendance issues. It is imperative for members to respect the mentors' time and schedule appointments responsibly.

12. Enforcement Rights

We hold the right, though not the obligation, to investigate potential breaches of these Terms. In the event of such violations, we have the authority to remove, restrict access to, or alter any content that is in contravention of these Terms.

13. Limitation of Liability Clause

Service Continuity and Errors: We do not assure that our services will always be uninterrupted, timely, secure, or free from errors. You acknowledge that our services may occasionally be suspended or removed without prior notice.

Liability Scope: Under no circumstances shall Sebastian Hewing Consulting LLC, its officers, directors, service providers, contractors, employees, and agents be liable for any injuries, losses, claims, or any direct, indirect, incidental, consequential, or other types of damages, including but not limited to lost profits, revenue, data loss, loss of goodwill, replacement costs, service interruption, or system failure. This applies regardless of whether the damages arise from contract, tort (including negligence), strict liability, or other forms, and encompasses damages resulting from the use of or reliance on our services, errors or omissions in our content, or any loss or damage incurred from using our services or content.

Accuracy and Interaction with Third Parties: We do not guarantee that the results obtained from the use of our services will be accurate or reliable. Furthermore, we will not be liable for your communications or interactions with any third parties you engage with through the use of our website.

Limitation Extent: Our liability is limited to the greatest extent permitted by law. In no event shall our total liability arising from or related to these Terms of Service exceed the amount you have paid via our website in the 12-month period prior to the event causing the liability, or 200 US Dollars, whichever is less.

By using our services, you agree to indemnify, defend, and hold harmless Sebastian Hewing Consulting LLC, its affiliates, and their officers, directors, service providers, contractors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including but not limited to reasonable legal and accounting fees. This indemnification covers any issues arising from or in any way related to the following:

  • Your access to or use of our website, its content, and services;
  • Any violations of these Terms of Service (ToS) by you;
  • Comments or information you have posted or provided;
  • Your interactions with any third parties or individuals as a result of using our services;

Non-Waiver of Rights: The failure of Sebastian Hewing Consulting LLC to exercise or enforce any right or provision of these Terms of Service (ToS) does not constitute a waiver of such right or provision.

Comprehensive Agreement: These ToS, along with any other operating rules posted on our website, represent the complete agreement and understanding between you and Sebastian Hewing Consulting LLC. They govern your use of our services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us (this includes any prior versions of the ToS).
